Effective October 27, 2026. These terms apply to LOOKOUT software from Peregrine Applied Sciences, Inc. ("Peregrine") licensed online at peregrineappliedsciences.com or with an access code from Peregrine. The agency or company that buys the license or receives the code is the "Customer."
1. License
Peregrine grants the Customer a non-exclusive, non-transferable license, for the term, to install and use LOOKOUT for the Customer's own operations:
- the ground-node software and LOOKOUT Station on the number of ground-node sites licensed;
- the LOOKOUT ATAK plugin and the aircraft-unit software on any number of the Customer's devices and aircraft units used with those sites.
A code issued with LOOKOUT RID Sensors covers the LOOKOUT ATAK plugin, for use with those sensors, at no license fee.
2. Term and renewal
A license runs 12 months from purchase, or for the period stated with the access code. It includes every LOOKOUT release published during the term. Renew before the end of the term to keep using LOOKOUT.
3. Access codes
Access codes are for the Customer's own staff. Do not publish or share them outside the Customer's organization. Peregrine may deactivate a code that is shared or misused.
4. Restrictions
The Customer may not sell, sublicense, rent or transfer LOOKOUT; reverse engineer it, except where the law allows despite this term; or remove or work around its legal controls, including the settings that limit radio-frequency features to the authority the deploying agency holds.
5. Lawful and advisory use
The Customer is responsible for using LOOKOUT in line with applicable law, including FAA, FCC, privacy and communications laws, and for any aviation approval its aircraft need, such as portable electronic device determinations. Drone operator locations are for law enforcement and authorized incident personnel only.
LOOKOUT is advisory awareness: a cue to look. It is not a separation or collision-avoidance system and does not replace see-and-avoid, traffic systems or air tactical direction. Alert thresholds are set during flight test.
6. Support
Peregrine provides installation help and support by email and phone during U.S. business hours for the term.
7. Customer data
LOOKOUT runs on the Customer's own computers and devices. Peregrine receives no operational data from it unless the Customer sends that data to Peregrine.
8. Export
LOOKOUT is subject to U.S. export control and sanctions laws. The Customer will not export, re-export or provide it to any country, entity or person barred by those laws. Online purchase is for U.S. customers; Peregrine confirms export eligibility for others before releasing a code.
9. Fees
Fees are stated at purchase, in U.S. dollars, and are non-refundable except as required by law or agreed by Peregrine in writing. Taxes are the Customer's, unless the Customer is exempt and provides proof.
10. Warranty and liability
Peregrine will correct reproducible defects reported during the term. Otherwise LOOKOUT is provided "as is," and Peregrine disclaims all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent the law allows. Peregrine's total liability under these terms is limited to the fees the Customer paid for LOOKOUT in the 12 months before the claim, and neither party is liable for indirect, incidental or consequential damages, to the extent the law allows.
11. U.S. Government customers
LOOKOUT is commercial computer software. U.S. Government customers receive it under these terms, consistent with FAR 12.212 and DFARS 227.7202. Where a term conflicts with federal law, federal law governs, and federal customers are not bound by the governing-law and indemnity provisions of any other agreement.
12. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except where federal law applies. A signed agreement between Peregrine and the Customer takes precedence over these terms.
